The Constitution of 1864 of the Kingdom of Hawaii Hawaiian Hawai okina i was a rewrite of the 1852 Constitution of the Kingdom of Hawaii 1852 constitution issued by Kamehameha III King Kamehameha III . It dramatically changed the way Hawaii s government worked by increasing the power of the king and changing the way the kingdom s legislature worked. It was Hawaii s constitution from 1864 through 1887, during the reigns of kings Kamehameha V , Lunalilo , and Kal kaua . Background Image Kamehamehav.jpg thumb 241px Kamehameha V wrote the Constitution of 1864. Kamehameha V ascended the throne in 1863. He was a firm believer that the king should be the person firmly in control of Hawaii s government, as it had been done in Hawaii for hundreds of years before the passage of the 1840 and 1852 constitutions. Kamehameha V as well as his predecessor, Kamehameha IV was often irritated by the controls on his power by the 1852 constitution. Thus, when Kamehameha V ascended the throne, he refused to take an oath to the 1852 constitution. Instead, he called for a constitutional convention. The Constitutional Convention For the convention, delegates were elected by the population. They met at Kawaiahao ... of 1864 brought several changes to Hawaii s government. The Constitution of 1852 served as the Constitution of the Kingdom of HawaiiKingdom of Hawai okina i from 1852 through 1864. It was passed during the reign of King Kamehameha III . It heavily liberalized the structure of the Hawaiian government compared to the previous 1840 Constitution of the Kingdom of Hawaii 1840 constitution , introducing new elements of democracy into the government and reducing the influence of the monarch in kingdom affairs. The 1852 Constitution of the Kingdom of Hawai okina i was divided into seven parts. The seven parts were 1. Declaration of Rights 2. Form of Government 3. Of the Executive Power a. Section I The King, His Prerogatives b. Section II Of the Kuhina Nui c. Section III Of the Privy Council d. Section IV Of the King s Ministers e. Section V Of the Governors 4. Of the Legislative Power a. Of the House of Nobles b. Of the House of Representatives 5. Of the Judiciary 6. General Provisions 7. More Amending of the Constitution The Declaration of Rights stated that the Hawaiians were a free people. The Form of Government stated that Hawai okina i was a Constitutional Monarchy. The section Of the Executive Power declared the powers of the executive power. The section Of the Legislative Power declared the powers of the legislative power. The section Of the Judiciary declared the powers of the judiciary. The General Provisions stated anything unmentioned earlier besides the amending power. The final section allowed for amending of the constitution.
